Before an employer will the start a formal dismissal procedure (at the UWV or the District Court), he or she will sometimes offer you a settlement agreement (or termination agreement) first. Sometimes an employer is obliged to do so, based on the rules of a social plan.
If the employer offers you a settlement agreement, ask him to put the proposal in writing so we can perform a legal check on this document for you.
We will check the contents of the termination agreement and the reason for the dismissal. If there are errors in this agreement, you could lose your unemployment rights, your right to a redundancy payment and your right to have to pay out salary.
Given these significant financial consequences, it is advisable to always seek legal advice of an employment lawyer. Not infrequently, the negotiations performed by us have led to an increase of thousands of euros extra in severance pay.
